Covid-19 Update

With the ongoing situation with Corona virus, here at Elysium Instruments we have made extensive changes to the way we work. Our store is now closed and all our head office staff are working remotely. We have considerably reduced our workforce in our warehouse and have strict measures in place to follow all government guidelines. The safety of our employees and customers is paramount and we are taking every measure to ensure we can operate as best as possible. We look forward to returning to normal as soon as the time is right. Take Care.

Definitions

In these terms and conditions ´The Seller´ means Elysium Instruments and ´The Buyer´ means the purchaser of goods from ´The Seller´ under these terms and conditions.

Trade Only

Elysium Instruments Inc. operates exclusively as a manufacturer, it does not sell directly to the General Public. It does not deal with Consumer Sales. All sales are to the Trade. By placing an order with Elysium Instruments you are confirming that you are not a Consumer for the purposes of the Consumer Credit legislation and for the Purposes of Sale of Goods legislation and that you are in business and purchasing the goods for the purpose of that business and not for personal use. All products sold on this website are intended for those qualified in the hairdressing or beauty trade and are for sale on a trade only basis. Customers should be qualified to use the products sold on this website. Goods are sold on the understanding that they will be used for their intended purpose. No responsibility will be accepted by The Seller, for trained or untrained personnel without qualified supervision using or mis-using equipment supplied by The Seller. If you are a business customer, it is your responsibility to ensure that you are insured for products that you are using and we reserve the right to ask you for proof of professional status.

Prices

Prices and special offers are correct at the time of goods being displayed on the website but are subject to alteration without prior notice. Prices are exclusive of VAT at the ruling rates and delivery costs. VAT is not charged on educational books. It is possible that some of the products in our catalog may be mis-priced. 

We will verify pricing when processing your order and before we take payment.  If we have made a mistake and a product’s correct price is higher than the price on the website, we may either contact you before shipping to request whether you want to buy the product at the correct price or cancel your order.  If a product’s correct price is lower than our stated price, we will charge the lower amount and send you the product.

Delivery charges outside Pakistan will be verified when processing your order.  If we have made a mistake and the delivery charge is higher than the price quoted, we may contact you before shipping to request whether you want to continue with your purchase at the correct delivery charge or cancel your order.

Discounts & Special Offers

All offers are subject to availability. All products within clearance are excluded from any further discounts.

Further discounts cannot be applied to any items that are already discounted.

Discount Codes:
Orders must be over the qualifying amount, excluding VAT and delivery to qualify. Discount codes cannot be used in conjunction with any other offer or promotion. Discount codes are not valid in the Superstore. Reward Points cannot be accrued. Free delivery is NOT valid when using discount codes unless stated otherwise. 

Brand Ambassador Instagram Codes: 
10% off. No minimum order applies. Free delivery is not valid when using these offer codes.

Social Media Codes:
We routinely provide codes for affiliate or promotions in different social media platforms. Theses codes are valid for the duration of the promotion unless stated otherwise. 

Email Sign Up Code: 
Codes sent through email promotional program are valid for the duration listed unless stated otherwise.

Delivery charges will be finalized on the final invoice of the material. Note that all responsibility of delivery lies solely on the Buyer as the method of delivery is chosen by the Buyer and is under no control of the Elysium Instruments.

Social Media Competitions

  • In the event of multiple correct entries the winner will be determined by a draw.
  • The source of the answer will be stated after the draw.
  • The decision of Elysium Instruments is final.
  • Elysium Instruments reserve the right to substitute elements of the prize depending on availability.
  • Competitions are entirely free to enter. No purchase is necessary.
  • Competitions are not open to anyone connected with the competition.
  • All closing dates and times are based on the current Pakistan local time.
  • The winner will be selected at random from all entries.
  • The winner will be informed via email. They must respond to this email within 7 days to prevent the prize being offered to an alternative winner.
  • No cash alternatives to the prize can be offered. 
  • All entrants must be in the trade.
  • Entries made through private Instagram profiles cannot be counted, due to privacy restrictions. 
 

Overdue Accounts

After 40 days a surcharge of 4% of the gross amount will be levied on a daily basis.

Your Online Account

If you use this website you will be responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password. You must ensure that the password is kept confidential. If you believe that your password has become known to anyone else, you must inform us immediately.

Elysium Instruments reserves the right to refuse access to the website, terminate accounts, or cancel orders at our discretion. If we cancel an order you will not be charged.

Payment

Payment is due in full prior to start of production of goods if a credit arrangement is not agreed beforehand. Payment is due 30 days from the date of invoice where a credit agreement exists.

Please note, delivery addresses cannot be changed on an order by a customer once payment has been taken. We are unable to change your delivery address on orders paid by PayPal.  If you wish to make amendments to your delivery once an order has been made, please speak to a member of our Customer Service Team.

Online Orders

When you place an order to manufacturing of an item from Elysium Instruments, we will send you an email confirming receipt of your order and containing the details of your order after our representative talks with you on the nuances of the product. Your order represents an offer to purchase a product which is accepted by us when we dispatch that product to you. That acceptance will be complete at the time we dispatch the product to you. Any products on the same order which are not dispatched, do not form part of that contract.

Returned Goods

If goods have been ordered in error or are not as expected:
Please contact our Customer Services Department on +92 321 4449442 to request a returns authorization number. Please note, goods must be returned within 7 days of the returns reference being issued unless stated otherwise.

If goods have been ordered in error or are unsuitable:
The Buyer must pay for the return postage.

The relevant reference number must be quoted on accompanying documentation. Goods must be returned within 7 days of receipt, unused, in perfect condition and sent back in it´s original packaging.

If items are returned as unsuitable:
The Buyer will only be entitled to a refund on the item purchased and not the original postage paid. This process can take between 7-10 days to complete and for a refund to be issued.

Carriage for any alternative items is to be paid for by The Buyer. The Seller accepts no responsibility for items lost in transit.  It is recommended that a receipt of posting is obtained and it is the Buyers responsibility to ensure adequate insurance is purchased to cover the items being returned.  

Any faulty items which are still under the manufacturer’s warranty must be reported and sent back for inspection, once the goods are received back we will determine whether the item(s) can be repaired, if this is not the case then a replacement will be issued.  If we are unable to either repair or replace the item(s) then a full or partial refund may be issued.  This  process can take between 10-14 days, there are exceptions to this policy due to hygiene reasons – see exclusions.

Our warranties run from the initial date of purchase, if we have made the decision to replace a product that is still under warranty then this does not mean that you receive a new warranty when you receive a replacement. In essence the contract that you make at the time of sale, which includes the warranty, is formed at the time when you paid the money. Issuing a replacement is something that occurs under the original agreement and it does not mean that you receive a new warranty. Therefore, it is important to be aware that your original warranty will expire on the original purchase, rather than the clock being re-set on the warranty at the time when your item is replaced.

Refunds on large/heavy items will be subject to a minimum 10% handling charge.

Items are usually made with custom specifications of the Buyer and as for all custom orders, they are not returnable unless an agreement has already taken place beforehand.

Exclusions:

  • Porcelain basins and glassware e.g. mirrors & jars are non returnable.
  • All furniture which has been made to special order cannot be returned.
  • Items that are sent direct from the manufacturer are non-returnable if they are unsuitable. This does not affect your statutory rights. For more information please contact Customer Services.
  • Due to strict hygiene regulations, the Seller cannot accept returns of items such as scissors, clippers, razors, manicure or pedicure implements, tweezers and electrolysis needles which have been used. (This list is not exhaustive).
  • Goods returned damaged due to poor packaging will not entitle The Buyer to a full credit/refund. Your Statutory Rights are not affected.
 

Shortages & Damages

Goods must be inspected on delivery and all claims for shortages or damages must be reported to The Seller within 24 hours of receipt of goods. Please keep in mind that The Seller is only responsible for manufacturing defects. Shipping and delivery damages are beyond the scope of The Seller to monitor.

Delivery Charges

The delivery charges are the sole responsibility of the Buyer. Before the confirmation of the order, Buyer should state the medium or method of delivery and the charges will be quoted based on the current price based model quote according to the policy of the courier or delivery company. Any change in delivery will not be the responsibility of the Seller. Once dispatched, Elysium Instruments  does not hold any kind of responsibility or damages that may happen during the delivery of the products.

Delivery

The Seller’s policy is to dispatch goods within 24 hours of completion of production of the goods, however this can vary subject to stock availability and terms decided on the contract. Times quoted are in good faith, but shall not be binding. The Seller can accept no responsibility for transport delays causing late delivery. Some furniture orders may take up to 6-8 weeks for delivery, or up to 14 weeks for special order items. Extra handling charge may be incurred for re-dispatched parcels.

Elysium Instruments is not liable for delayed, missing or damaged parcels/contents if a delivery signature has not been obtained where the parcel has been left in a designated safe place at your request.  If you choose to have your order delivered to a location you deem as ‘safe’ then the liability transfers to you.

Please note, delivery addresses cannot be changed on an order by a customer once payment has been taken. We are unable to change your delivery address on orders paid by PayPal.  If you wish to make amendments to your delivery once an order has been made, please speak to a member of our Customer Service Team.

Large and Heavy Items

Please ask for carriage charges on the following items; porcelain basins, wash-points, hydraulic chairs, barbers chairs, portable, hydraulic and electric couches, large chairs, nail stations, reception desks and other large furniture items. This may include small items ordered in bulk quantities. This list is not exhaustive.

Any furniture ordered will be delivered to front door and ground floor premises only, as drivers are not insured to take upstairs or inside of premises.  

We advise that tradesmen who are booked to install items should only be arranged once in receipt of the goods.

Overseas Orders

We welcome orders from around the world. Carriage charges will vary depending on destination and weight of parcel.

Customs For Overseas Orders

When ordering goods from Elysium Instruments for delivery outside the Pakistan, you may be subject to import duties and taxes which are levied once the goods reach the specified destination. Any additional charges for Customs clearance must be paid by you; Elysium Instruments has no control over these charges and cannot predict what they may be. If you are ordering goods from outside the Pakistan, it is your responsibility to comply with all the laws and regulations in the country in which you are receiving the goods. 

If you refuse to pay the charges levied by customs and excise, or the delivery is unsuccessful, and the goods are returned to us then you will be liable for amount of goods and these are in no way considered for returns and Elysium Instruments will not be liable for any amount in return.

Cancellations

Prior to dispatch, non standard items such as furniture/special order items, cannot be cancelled. Cancellation after dispatch cannot be accepted.

Product Availability

All products are subject to stock availability. Stock availability is shown on the website, however if we have insufficient stock to fulfill the order, we will notify you by e-mail at the address given by you in your registration form. Stock is allocated on a first come first served basis once your order reaches our main server. The Seller doesn’t guarantee the availability of any item based on stock figures shown.

Elysium Instruments grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it except with the written consent of Elysium Instruments. Force Majeure

Elysium Instruments shall be entitled to cancel or delay delivery of orders if it is delayed, hindered or prevented from delivery through circumstances beyond its control. Such circumstances shall include (but are not limited to) industrial action, accident, fire, Act of God or failure to deliver by suppliers or carriers.

General

All offers are subject to stock or production material availability. The Seller reserves the right to restrict or refuse any order for application of credit at any time. The Seller takes special care to show correct sizes and specifications and such descriptions, whilst given as a guide, in good faith, are subject to alteration by The Seller without notice. All colors are as near as can be displayed on a computer monitor.

Guarantee

All items are guaranteed according to the manufacturer´s warranty that is stated at the time of order finalization. Any faulty items which are still under the manufacturer’s warranty must be reported and sent back for inspection, once the goods are received back we will determine whether the item(s) can be repaired, if this is not the case then a replacement will be issued.  If we are unable to either repair or replace the item(s) then a full or partial refund may be issued.  This  process can take between 10-14 days, there are exceptions to this policy due to hygiene reasons – see exclusions. All glass items are specifically excluded from this guarantee.

Our warranties run from the initial date of purchase, if we have made the decision to replace a product that is still under warranty then this does not mean that you receive a new warranty when you receive a replacement. In essence the contract that you make at the time of sale, which includes the warranty, is formed at the time when you paid the money. Issuing a replacement is something that occurs under the original agreement and it does not mean that you receive a new warranty. Therefore, it is important to be aware that your original warranty will expire on the original purchase, rather than the clock being re-set on the warranty at the time when your item is replaced.

REM Products – these products come with a years’ warranty which covers the cost of any replacement part and any labor costs incurred.  In addition to this some REM products have an additional two year warranty.  The additional warranty covers parts only for the remaining two years.

If you have a problem with an REM product that is covered under the three year warranty please contact our Customer Service Team and they can request a call to an REM engineer who will diagnose the fault.

Jurisdiction

These terms and conditions and all contracts entered into under them are governed by and are to be construed in accordance with the laws of Pakistan. You agree to submit to the jurisdiction of the Courts of Pakistan in relation to any contract entered into under these terms and conditions.

Retention of Title Clause

  1. The risk in all goods passes to The Buyer upon delivery but title in the goods remains vested in The Seller and shall only pass from The Seller to The Buyer upon full payment being made of all sums (due on whatsoever account or grounds) to The Seller.
  2. The Buyer agrees, prior to the payment of the whole price of the goods, The Seller or appointed agents may enter The Buyers premises to collect such goods should The Seller request. Prior to such payment, the Buyer shall keep the goods separate and identifiable for the purpose and return the goods to The Seller should The Seller request.
